POWER COUNTY, Idaho -- An American Falls man who escaped from the Power County Jail in October 2009 was sentenced on Thursday.
Gilberto Delgado will spend at least 11 years behind bars before being eligible for four years of probation. His new sentence will be served concurrently with his prior sentences. He was also fined $2,500 for each charge.
The 38-year-old pleaded guilty to escape and felony assault on a corrections officer in July.
The state requested $260 in restitution for damages to the jail in the escape, which the judge imposed. However, defense attorney John Souza said he thought the court would hear that plea at a later date. The defense has 30 days to contest the fine, something Souza said he plans to do.
Prosecutor F. Randall Kline said Delgado may be a nice guy, but he has a 22-year criminal history and doesn’t think that is going to change.
Delgado admitted what he did was wrong, but blamed his actions on abuse of drugs and alcohol. He told the court that today he is looking for treatment, but tomorrow, he doesn’t know what he’ll want.
Delgado’s mother also addressed the court. She said under the drugs and alcohol, her son is a different person and hopes to see him come home.
Another inmate, Rudolfo Ortega, pleaded guilty to escape, battery on corrections personnel and kidnapping earlier this year for his role in the crime. He has since been sentenced and is currently in jail.
Delgado has 42 days to appeal his sentence.
