Attorneys for a 31-year-old Utah man convicted of lewdness for flashing diapers he was wearing in front of children are pushing for the Utah Supreme Court to overturn his convictions.
Barton Bagnes was convicted in 2010 in for the incident a year earlier where he exposed his diaper to two girls while sucking on a candy pacifier and throwing fliers.
Bagnes' attorney Joanna Landau told the Utah Supreme Court earlier this month that her client's behavior "was not sexual, it was just strange."
Prosecutors equated the diaper with underwear and argued the fliers Bagnes was distributing included web addresses for sites that showed sexually explicit images of children.
The Salt Lake Tribune reports the Utah Supreme Court may not issue a ruling on his case for months.
